Explaination – Indian Constitution Article 102 deals with the disqualification of MPs from Lok Sabha or Rajya Sabha. The Speaker of the Lok Sabha or the Chairman of the Rajya Sabha can make a decision on the disqualification of an MP based on the opinion of the Election Commission. However, if any MP is aggrieved by such a decision, he/she can challenge it in the High Court or the Supreme Court of India.
